Oscillate Audio

Terms of service

Version 1.6 · 21 October 2026

These terms govern your purchase and use of anything sold on oscillateaudio.com. They are written to be read, not to be survived. Where a plain sentence and a legal one disagree, the plain sentence is what we meant.

1. Who you are dealing with

Oscillate Audio is the trading name of Sarah Johnston, a sole proprietor based in Germany (Moosackerweg 30, 87544 Blaichach-Gunzesried). Full details are in the imprint.

Your purchase contract is not with us directly. Our order process is conducted by our online reseller Link (Sold through Link, LLC, a Stripe company). Link is the merchant of record for all our orders: the purchase contract for a paid product is concluded with Link under the terms shown in the checkout, and the purchase appears as “Sold through Link” at checkout, on your receipt and as LINK.COM* on your card statement. The reseller is the seller on your receipt, the party that charges your payment method, and the party that handles sales tax and VAT for your country. Its buyer terms, linked in the checkout, apply to the payment itself.

2. What we sell

Audio plug-ins (AU, VST®3 and standalone applications), Max for Live devices and digital audio files, delivered as a download. Paid plug-ins are unlocked with a serial number that reaches you by email. Nothing is shipped, nothing is streamed, and nothing requires an account or a licence server. What you download is yours to keep on your own machines.

Free devices. Some devices are free: you receive them in exchange for your email address and a subscription to our newsletter, and we say so on the sign-up form. You can unsubscribe at any time with one click; the device stays yours and keeps working. No payment is ever taken for a free device.

3. Prices and tax

Prices on product pages are shown in US dollars before sales tax or VAT. The total for your country, including tax and in your local currency, appears in the checkout before you pay, with the tax listed separately, and it is the amount charged.

New products are sold at their list price from the first day. We do not run time-limited discounts or sales.

We may change prices at any time. A change never affects a purchase already made.

4. Delivery

A personal download link appears immediately after payment and is also sent to the email address you gave at checkout. The link is valid for 72 hours and works up to five times.

If a link expires, fails, or never arrives, that is our problem to fix, not a refund case. Write to [email protected] with your order number and we reissue it. There is no deadline on that.

5. What you may do with it

Everything you make with our products is royalty-free for use in your own work, including commercial releases, with no credit and no clearance required. The software, the files and your serial number are for you alone: do not share, resell or redistribute them. The full terms are on the licence page and form part of this agreement. Third-party components keep their own licences, listed on the credits page.

6. Refunds

Every product is delivered as an immediate download. Before checkout you agree that delivery starts immediately and acknowledge that you thereby lose your statutory right of withdrawal. Refunds are given where a product does not work as described (section 9) and for an accidental duplicate purchase, as set out on the refunds page.

7. Your account — there isn't one

We do not create accounts and we do not store passwords. Your download link is the only credential involved, which is why it is personal to you and why sharing it is a breach of the licence.

8. Fair use of this site

Do not attempt to circumvent the download limits, script the checkout, or take the site apart looking for files. If you find a way in, tell us — we would rather hear it from you than from somebody selling the pack.

9. If something does not work

What a product does is described on its product page and in its manual, together with the system requirements. Please check those before buying. If a product does not work as described, write to [email protected]: we fix it with an update, and if we cannot, you get a full refund.

If you are a consumer, you keep all your statutory rights for digital products, including the right to a product that works as described and to the updates needed to keep it that way. Nothing in these terms or in the licence limits those rights.

9a. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, for fraud, under product liability law, and where we have given an express guarantee.

For slight negligence we are liable only if we breach an essential obligation — one that makes the contract possible in the first place and on which you may rely, such as delivering a working product — and then only for the damage that was foreseeable and typical when you bought. Otherwise we are not liable for slight negligence.

Please keep backups of your projects. If data is lost, our liability is limited to what it would have taken to restore it from regular backups, unless the loss falls under the first paragraph of this section.

Where neither consumer protection law nor the first paragraph of this section applies, for example for business customers outside the EU and the UK, our total liability is in addition limited to the price paid for the product concerned.

10. If we stop

Nothing you bought stops working. There is no licence server to switch off and nothing expires. Files already on your disk remain yours under the licence, whatever happens to us.

11. Updates

All future updates to a product you have purchased are included at no additional cost for as long as we offer that product. There is no subscription and no upgrade fee. A separate successor product (with a new name) is not an update; it is a new product with its own price, and buying it is up to you. What each update changes is listed in the changelog, and the current version is always available to you under My licenses. Your statutory rights regarding updates of digital products remain unaffected.

12. Changes to these terms

We may update this page. The version and date at the top always say which text is current. A change applies to purchases made after it is published, never retroactively.

13. Law and disputes

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of the mandatory law of the country where you have your habitual residence, and you may bring proceedings there.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

Questions about any of this go to [email protected]. A person answers, and it is the same person who built the thing.
